These General Terms and Conditions of Sale (hereinafter the "GTCs") govern sales made through the KÏORA online boutique, accessible at kïora.com.

The KÏORA boutique offers clothing and textile accessories designed and manufactured by Lilimay Turpin for sale.

Any order placed on the website entails the customer's full and complete acceptance of these GTCs.

The website is primarily intended for consumers making purchases for their personal needs.


ARTICLE 2 — PURPOSE

These GTCs are intended to define the rights and obligations of KÏORA and its customers in connection with the online sale of products offered on the website.

They apply to all orders placed on the website by a consumer.

Before placing any order, the customer acknowledges having read and accepted these GTCs.

The applicable GTCs are those in force at the time the order is validated.

KÏORA reserves the right to modify these GTCs at any time. However, the modifications will not apply to orders already validated.


ARTICLE 3 — PRODUCTS

The products offered for sale are those presented on the website on the date of consultation, subject to availability.

KÏORA takes the greatest care in presenting and describing its products.

The photographs, illustrations, and descriptions appearing on the website are intended to present the essential characteristics of the products.

In particular, due to screen display conditions, the lighting used when taking photographs, and the characteristics inherent to textile materials, the colors and textures visible on screen may differ slightly from the product received. The same applies to the shape, which may vary depending on the fabric or size selected by the buyer.

Where these differences are minor and do not affect the essential characteristics of the product, they shall not give rise to any liability on the part of KÏORA.

KÏORA may also offer pieces produced in limited quantities.

When a product is indicated as out of stock, it cannot be ordered, unless otherwise indicated.


ARTICLE 4 — MADE-TO-ORDER OR PERSONALIZED PRODUCTS

Certain products may be made specifically at the customer's request or personalized.

When a product is clearly identified as being personalized or made according to the customer's specifications, the statutory right of withdrawal may not apply in accordance with the exceptions provided for in Article L.221-28 of the Consumer Code.

This exception does not automatically apply to all artisanal products: it concerns, in particular, goods made according to the consumer's specifications or clearly personalized.

When a standard product is simply manufactured or prepared after the order without personalization requested by the customer, the statutory right of withdrawal remains applicable, subject to the exceptions provided by law.


ARTICLE 5 - PRICES

Product prices are indicated in euros (€).

The prices displayed on the website are those applicable at the time of the order.

Delivery charges are not necessarily included in the product price. Where applicable, they are indicated to the customer before the final validation of the order.

KÏORA reserves the right to change its prices at any time. However, the price charged to the customer is the price displayed when the order is validated.

Any promotions and discounts are applied in accordance with the terms indicated on the website.


ARTICLE 6 - PRODUCT AVAILABILITY

Products are offered subject to availability.

In the event of exceptional unavailability of a product after an order has been validated, KÏORA shall inform the customer as soon as possible.

The customer may then, depending on the situation:

  • accept a new delivery period;
  • request cancellation of the order concerned;
  • obtain reimbursement of the corresponding amounts.

KÏORA shall not be held liable for unavailability resulting from an event beyond its control.


ARTICLE 7 - ORDER

To place an order, the customer selects the product or products they wish to purchase and adds them to their basket.

The customer then checks the contents of their basket, their contact details, their delivery address and the information relating to their order.

Before final validation, the customer may modify or correct the information entered.

The customer then validates their order after having read these GTCs.

Validation of the order entails a payment obligation.

The order becomes final after payment has been confirmed and the customer has received an order confirmation email.

KÏORA recommends that the customer retain this email.


ARTICLE 8 - REFUSAL OR CANCELLATION OF AN ORDER

KÏORA reserves the right to exceptionally refuse an order for a legitimate reason, particularly in the event of:

  • product unavailability;
  • a manifest error in the price or product description;
  • suspected fraud;
  • a payment-related issue;
  • an order presenting an abnormal or abusive nature.

In this case, the customer will be informed and any amounts paid will be refunded.


ARTICLE 9 — PAYMENT

Payment is due at the time the order is placed.

The payment methods available are those offered on the website at the time the order is placed.

Payments are processed by the payment service providers offered by Shopify and/or by the payment service providers selected by KÏORA.

KÏORA does not have access to the customer's complete banking details where these are processed directly and securely by the payment service provider.

The order is created, prepared and dispatched only after payment confirmation, unless otherwise indicated.

If payment is refused, the order may be cancelled.


ARTICLE 10 — DELIVERY

The products are delivered to the address indicated by the customer when placing the order.

Before the order is validated, KÏORA indicates the applicable delivery period or timeframe, as well as any delivery charges.

The periods may vary depending on the destination, the delivery method selected, product availability and any preparation periods.

Where the product is manufactured or prepared to order, a preparation period may be required before it is dispatched.

KÏORA undertakes to deliver the product within the period indicated to the customer.

In the absence of any indication of a specific period, delivery must take place no later than within the periods provided for by the applicable legislation.

In the event of a delivery delay, the customer has the rights provided for by the French Consumer Code.

The customer is invited to check the accuracy of their address before validating their order.

In the event of an incorrect or incomplete address provided by the customer resulting in a new shipment, additional charges may be requested where these result directly from the customer's error.


ARTICLE 11 — RECEIPT OF THE ORDER

Upon receipt of the parcel, the customer is invited to check the apparent condition of the parcel and the product.

If a product is received damaged, incorrect or presenting an anomaly, the customer must contact KÏORA as soon as possible at:

The customer may attach photographs showing the problem.

This process facilitates the handling of the request but does not deprive the customer of the rights conferred by statutory warranties.


ARTICLE 12 — RIGHT OF WITHDRAWAL

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer has, except where otherwise provided by law, a period of fourteen (14) days from receipt of the product to exercise the right of withdrawal without having to provide justification for the decision.

Where the order comprises several products delivered separately, the period shall run from receipt of the last product.

The customer must inform KÏORA of the decision to withdraw before the expiry of the fourteen-day period.

The customer may use the standard withdrawal form appearing at the end of these GTCs or send any clear statement expressing the intention to withdraw.

ARTICLE 13 - RETURN OF PRODUCTS

After informing KÏORA of the decision to withdraw, the customer has a maximum period of fourteen (14) daysto return the product.

The products must be returned in a condition allowing them to be resold, insofar as possible, together with any accompanying components.

The customer shall be liable for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.

The direct costs of returning the product shall be borne by the customer, unless KÏORA expressly states that it will bear them or the law provides that they must be borne by KÏORA.

The customer is advised to use a shipping method that provides proof of posting and a tracking number.


ARTICLE 14 - REFUND

In the event of a valid exercise of the right of withdrawal, KÏORA shall refund the customer the amounts paid, including the initial delivery costs corresponding to the standard delivery method offered at the time of the order.

If the customer chose a delivery method more expensive than the standard delivery method offered by KÏORA, the corresponding additional amount will not necessarily be refunded.

The refund shall be made within a maximum period of fourteen (14) days from the date KÏORA receives the customer's decision to withdraw.

However, KÏORA may defer the refund until it has recovered the product or until the customer provides proof of shipment of the product, whichever occurs first being the applicable date.

The refund shall be made using the same means of payment as that used for the order, unless the customer expressly agrees to another method that does not incur additional fees.


ARTICLE 15 - EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, certain products do not benefit from the right of withdrawal.

This may in particular concern goods made to the consumer's specifications or clearly personalized.

When this exception applies to a KÏORA product, this information will be clearly indicated before the order is placed.

This exception may not be used to remove the right of withdrawal for a standard product that is not personalized when the law provides that this right applies.


ARTICLE 16 — STATUTORY WARRANTIES

KÏORA is subject to the statutory warranties applicable to products sold to consumers.

The customer benefits in particular from:

  • the statutory warranty of conformity;
  • the statutory warranty against latent defects.

The statutory warranty of conformity applies in particular when the product has a lack of conformity existing at the time of delivery or does not meet the criteria laid down by law.

In the event of a defect, the customer may contact KÏORA to have their claim handled in accordance with the applicable legal provisions.

The statutory warranties apply independently of any commercial warranty that may be offered by KÏORA.


ARTICLE 17 — GARMENT CARE

Textile products must be cared for in accordance with the instructions on their care label and/or the recommendations provided with the product.

KÏORA shall not be held liable for damage resulting from care contrary to the recommendations provided.

Normal wear and tear of a garment, resulting in particular from normal use or repeated washing, does not necessarily constitute a lack of conformity.


ARTICLE 18 — LIABILITY

KÏORA is responsible for the proper performance of the obligations arising from the contract concluded with the customer, under the conditions provided for by French law.

However, KÏORA shall not be held liable for damage resulting from:

  • improper use of the product;
  • maintenance not carried out in accordance with the recommendations;
  • a modification of the product carried out by the customer or by a third party;
  • an event of force majeure;
  • an error made by the customer in the information necessary to execute the order.

These provisions may not have the effect of depriving consumers of their statutory rights.


ARTICLE 19 — INTELLECTUAL PROPERTY

All elements appearing on the KÏORA website, including photographs, texts, logos, graphics, illustrations, drawings, designs, creations, videos, visual elements, names and distinctive signs, are protected by intellectual property laws.

Without KÏORA's prior written authorization, any reproduction, representation, modification, adaptation, distribution or exploitation, in whole or in part, of these elements is prohibited.

Ordering a KÏORA product does not entail any transfer to the customer of the intellectual property rights relating to the brand, designs, photographs or creations.


ARTICLE 20 — PERSONAL DATA

In connection with order management, KÏORA may collect certain personal data necessary in particular for order processing, payment, delivery, customer relationship management and compliance with legal obligations.

The data are processed in accordance with the applicable personal data protection regulations, in particular the GDPR.

The customer may exercise the rights granted to them under the applicable regulations.

Detailed information concerning the processing of personal data, the purposes, recipients, retention periods and the customer's rights is presented in the Privacy Policy of KÏORA.


ARTICLE 21 — COOKIES

The KÏORA website may use cookies and other trackers necessary for its operation and, depending on the features enabled, cookies intended in particular for analytics, personalisation or advertising.

Where the visitor's consent is required, it is collected in accordance with the applicable regulations.

Information relating to cookies and the methods for managing consent is detailed in the Privacy Policy / Cookie Policy of KÏORA.


ARTICLE 22 — CUSTOMER SERVICE AND COMPLAINTS

For any question, request or complaint concerning an order, the customer may contact KÏORA via the contact form

KÏORA recommends that the customer provide their order number and any information useful for analysing their request.

KÏORA will endeavour to process complaints as quickly as possible.



ARTICLE 23 — DISPUTE RESOLUTION

In the event of a dispute, the customer is invited to contact KÏORA as a priority in order to seek an amicable solution.

The customer may also, where the legal conditions are met, have recourse to consumer mediation.

Recourse to mediation does not prevent the consumer from exercising any other remedies available to them in accordance with the law.


ARTICLE 24 — APPLICABLE LAW

These General Terms and Conditions of Sale are governed by French law.

Where a consumer customer resides in another Member State of the European Union, the mandatory consumer protection provisions applicable to that customer in their country of residence may also apply.

In the event of a dispute, the competent courts shall be determined in accordance with the applicable legal rules.
